1. INTRODUCTION

Welcome to Ahrism1! We provide a number of services for our members to participate in and connect with others. By accessing and using our properties, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. ACCOUNT REGISTRATION

To use certain features of our communities, you may be required to register for an account with a third-party provider. When registering for an account, you agree to provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password confidential. You must notify the respective provider immediately of any breach of security or unauthorized use of your account, and us if you believe such use has taken action on your behalf when interacting with Ahrism1.

2.1 CHARGEBACKS AND OUTSTANDING BALANCES

If a chargeback is initiated from your account, if there is an outstanding balance due to Ahrism1, or if it is discovered that you've gained unauthorized access to paid content, we may suspend your account access. To regain access to our services, you must repay any outstanding amount or rectify unauthorized access as stipulated by Ahrism1. Multiple chargebacks, unauthorized accesses, or outstanding balances may result in indefinite  suspension of your account.

3. CONTENT

Our communities may include user-generated content, such as messages, comments, and other materials. You are solely responsible for the content that you post or transmit to our communities. By posting or transmitting content to our communities, you grant Ahrism1 a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content.

This means that Ahrism1 has the right to use your content in a variety of ways, including displaying it on our platforms, showing it to other members, or using it for promotional purposes. However, this does not mean that Ahrism1 is "stealing" your content. You still retain ownership of your content and are free to use it as you wish. The rights granted to Ahrism1 simply allow us to use your content in a way that helps to run and promote our services.

3.1 DMCA REPORTING

If you believe that any content within any of our communities infringes upon your intellectual property rights, you agree to alert us. We are committed to addressing and resolving such concerns.

Choosing to bypass our internal reporting procedure and filing a DMCA complaint with any external entity without allowing Ahrism1 the opportunity to address the issue will be viewed as an action taken in bad faith. Consequently, such individuals may have their access revoked at our discretion.

4. PROHIBITED CONDUCT

You agree to not use our communities for any illegal or unauthorized purpose. You agree to not engage in any conduct that is harmful to other users, including bullying, harassment, or discrimination. You agree to not post or transmit any content that is inappropriate, offensive, or illegal. You agree to not engage in any activity that could disrupt the functioning of our communities, including spamming or hacking.

 You also agree to adhere to the Ahrism1 Community Guidelines, which outline specific behaviours that are prohibited within our communities. If you are unsure about whether a particular behaviour is acceptable, we encourage you to review the Community Guidelines or contact your local support staff for more information.

5. SECURITY

Our communities are moderated by a team of volunteers and staff members. They have the right to remove any content that violates these Terms or the community guidelines. They also have the right to apply punitive action to users who engage in prohibited conduct.

6. TERMINATION

Ahrism1 reserves the right to terminate or suspend your access to our communities at any time, with notice, for any reason falling under our Community Guidelines, including violation of these Terms.

7. DISCLAIMER OF WARRANTIES AND LIABILITY

Our communities are provided on an "as is" and "as available" basis. Ahrism1 makes no warranties, express or implied, as to the operation of our communities or the information, content, materials, or products included on them. Ahrism1 will not be liable for any damages of any kind arising from the use of our communities, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Ahrism1 is not responsible for any damages that may result from the use of our communities. You use our communities at your own risk.

8. GOVERNING LAW

This Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this Terms of Service shall be filed only in the provincial or federal courts located in Toronto, Ontario, Canada and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

9. DISPUTE RESOLUTION

Any disputes between Ahrism1 and a member will first be attempted to be resolved privately. If a resolution cannot be reached, the dispute will be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration will be conducted in Toronto, Ontario, Canada. The arbitration will be conducted in the English language. The award of the arbitration will be final and binding upon the parties. The parties agree to waive their right to a trial by jury. The parties further agree to waive their right to participate in a class action lawsuit or class-wide arbitration.

10. SEVERABILITY

If any provision of this Terms of Service is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

11. WAIVER

The failure of Ahrism1 to exercise or enforce any right or provision of this Terms of Service shall not constitute a waiver of such right or provision.

12. AGREEMENT

This Terms of Service constitutes the entire agreement between you and Ahrism1 and governs your use of the Ahrism1 communities, superseding any prior agreements between you and Ahrism1. You may also be subject to additional terms and conditions that may apply when you use or access certain services or materials, including but not limited to age-restricted, preview, or employee-privileged content.

13. CHANGES TO THE TERMS OF SERVICE

Ahrism1 reserves the right, at its sole discretion, to modify or replace this Terms of Service at any time. If a revision is material, Ahrism1 will notify users of any new terms through a Rule Announcement, which is used to announce and notify of any major changes to our policies and rules. What constitutes a material change will be determined at Ahrism1's sole discretion. By continuing to access or use the Ahrism1 communities after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must discontinue your use of Ahrism1 services.
